1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and FieldMind AI ("FieldMind AI," "we," "us," or "our"), governing your access to and use of the FieldMind AI AI phone answering, job booking, and dispatch automation services (collectively, the "Service").
By signing a Pilot Service Agreement, Standard Subscription Agreement, or otherwise accessing or using the Service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.
If you do not agree with any part of these Terms, do not use the Service.
2. Description of Service
FieldMind AI provides a done-for-you AI phone answering and Jobber integration service for field service businesses, including but not limited to HVAC, plumbing, electrical, appliance repair, garage door, locksmith, pest control, lawn care, roofing, restoration, and pool & spa companies.
The Service includes:
- Configuration and deployment of an AI phone answering agent (voice AI powered by Bland.ai) on your business phone line
- Integration with your Jobber field service management account to create job records from AI-handled calls
- Emergency call routing to your on-call technician or designated contact
- Optional: outbound SMS follow-up for quote leads, booking confirmations, and appointment reminders
- Monthly performance reporting showing calls handled, jobs booked, and estimated revenue recovered
- Ongoing support, monitoring, and configuration updates
What FieldMind AI is not: We are a service provider, not a software reseller. You are buying an ongoing managed service, not a software license. We configure, deploy, and maintain the AI on your behalf.
3. Service Plans and Pricing

Pricing is subject to change with 30 days' written notice to active clients. Changes will not affect your current billing period.
Clients who convert from Pilot to Standard will retain their negotiated Pilot rate until they voluntarily choose to upgrade, subject to the rate-lock terms in their service agreement.
4. Billing and Payment
4a. Billing Cycle
Service fees are billed monthly in advance. Your billing date is established when you sign your service agreement. Payment is due within 7 days of each invoice date.
4b. Payment Methods
We accept credit/debit cards and ACH bank transfers processed through Stripe. By providing payment information, you authorize FieldMind AI to charge your payment method on the applicable billing schedule.
4c. Late Payment
Accounts that are 14 days past due may be suspended (AI deactivated) until payment is received. Accounts that are 30 days past due may be terminated. We will notify you via email before suspension or termination.
4d. Pilot Plan Guarantee
Pilot plan clients are eligible for a full refund if the Service does not deliver measurable value within 60 days. "Measurable value" means at least one successfully booked job created in Jobber via the AI system. Refund requests must be submitted in writing within 60 days of service activation.
4e. No Refunds After Pilot
Standard and Growth plan fees are non-refundable except as required by applicable law or as explicitly provided in your service agreement. If you cancel mid-month, no partial refunds are issued for the current billing period.
5. Term and Termination
5a. Pilot Term
The initial Pilot engagement runs for 60 days. Either party may terminate during the Pilot with 7 days' written notice. At the end of the Pilot period, the Service automatically converts to Standard unless you notify us of cancellation at least 7 days before the Pilot end date.
5b. Standard / Growth Term
Standard and Growth plans are month-to-month. Either party may terminate by providing 30 days' written notice. Notice must be provided via email to support@fieldmindai.co.
5c. Termination for Cause
FieldMind AI may terminate your account immediately, without notice, if you:
- Violate any provision of these Terms
- Use the Service for illegal purposes
- Engage in behavior that endangers callers (e.g., disabling emergency routing against our recommendation)
- Fail to make timely payment for 30+ days
5d. Effect of Termination
Upon termination: (1) call forwarding to your FieldMind AI number will be deactivated; (2) you retain all job records already created in Jobber (those are in your Jobber account); (3) FieldMind AI will provide a final performance report covering the final billing period; (4) your account data is available for export for 30 days after termination, then deleted per our Privacy Policy.
6. Your Responsibilities
As a Service Client, you agree to:
- Provide accurate business information during onboarding (business hours, service types, emergency contact, service area). Inaccurate configuration may cause the AI to provide incorrect information to callers.
- Maintain your Jobber account in good standing. FieldMind AI requires an active Jobber subscription with API access enabled. If your Jobber account is suspended or API access is revoked, the integration will fail until resolved.
- Comply with call recording laws in your jurisdiction. We provide a recording disclosure option; it is your responsibility to activate it if required by your state.
- Respond to escalated calls. Emergency routing only works if the designated on-call number is active and answered. FieldMind AI is not liable for missed emergency calls where the designated contact did not answer.
- Not use the Service for deceptive practices. You may not configure the AI to deceive callers in ways that harm them (e.g., false pricing, false availability, impersonation of a different company).
- Notify your team about the AI system before go-live, as described in the client onboarding materials we provide.
7. Service Availability and Performance
7a. Uptime
FieldMind AI targets 99.5% monthly uptime for the AI answering service. Uptime is measured as the percentage of time the AI is available to answer and process calls. Scheduled maintenance windows (if required) will be communicated 48 hours in advance and scheduled during low-call-volume hours (2:00–5:00 AM local time).
7b. Service Credits
If the Service experiences an unplanned outage exceeding 4 consecutive hours that results in missed calls, FieldMind AI will provide a prorated service credit equal to the number of days affected. Service credits are applied to the next billing period and are not refundable as cash.
7c. Third-Party Dependencies
The Service relies on third-party platforms including Bland.ai (voice AI), Make.com (automation), Jobber (FSM integration), and Twilio (SMS). FieldMind AI is not responsible for outages or service degradations caused by these third-party providers, though we will communicate status and expected resolution times promptly.
7d. AI Performance Limitations
The AI system performs well for standard booking and service-request calls but may not handle all edge cases correctly. FieldMind AI does not guarantee that the AI will successfully book 100% of calls or handle every conversation correctly. We continuously improve the AI configuration based on call review and client feedback. If you identify AI errors, please report them to support@fieldmindai.co so we can correct them.
8. Intellectual Property
8a. FieldMind AI Property
The AI system configuration, conversation flow design, prompt engineering, integration architecture, and all FieldMind AI branding, documentation, and content are the intellectual property of FieldMind AI. The Service is provided to you under a non-exclusive, non-transferable license for the duration of your subscription.
8b. Your Data
You own your client data, call records, and Jobber job data. FieldMind AI does not claim ownership of data generated on your behalf through the Service. See our Privacy Policy for how we handle and retain your data.
8c. Feedback
If you provide suggestions, ideas, or feedback about the Service, you grant FieldMind AI a non-exclusive, royalty-free license to use that feedback to improve the Service without restriction or compensation to you.
9. Confidentiality
Each party agrees to keep confidential any non-public business information disclosed by the other party in connection with the Service ("Confidential Information"). Confidential Information includes but is not limited to pricing terms, client lists, business configurations, and technical integration details.
Confidential Information does not include information that: (a) becomes publicly available through no fault of the receiving party; (b) was already known to the receiving party before disclosure; or (c) must be disclosed by law or court order (in which case the disclosing party will provide reasonable notice).
For FieldMind AI, this means: we will not share your client data, business configuration, or call records with any other businesses. Your Jobber credentials are encrypted and used only to operate your integration.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- FIELDMIND AI'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES YOU PAID TO FIELDMIND AI IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
- FIELDMIND AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR LOST BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
- FIELDMIND AI IS NOT LIABLE FOR MISSED EMERGENCY CALLS WHERE: (A) THE DESIGNATED ON-CALL NUMBER DID NOT ANSWER; (B) THE EMERGENCY ROUTING WAS NOT CONFIGURED; OR (C) THE OUTAGE WAS CAUSED BY A THIRD-PARTY PLATFORM.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
11. Indemnification
You agree to indemnify and hold harmless FieldMind AI and its officers, employees, and contractors from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your violation of these Terms
- Your use of the Service in violation of applicable laws (including call recording laws)
- Any false or misleading information you provided during onboarding
- Claims by your callers arising from the content of AI conversations that you configured or approved
12. Dispute Resolution
12a. Informal Resolution
Before initiating formal dispute resolution, you agree to contact FieldMind AI at legal@fieldmindai.co and attempt to resolve the dispute informally. We will respond within 10 business days. Most service concerns can be resolved quickly through direct communication.
12b. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to conflict of law principles.
12c. Jurisdiction
Any legal action or proceeding arising from these Terms shall be brought exclusively in the state or federal courts located in Cook County, Illinois. Both parties consent to personal jurisdiction in those courts.
12d. Waiver of Class Action
Any disputes must be brought on an individual basis. You waive any right to bring disputes as a class action, class arbitration, or representative action.
13. General Provisions
13a. Entire Agreement
These Terms, together with your signed Pilot Service Agreement or Standard Subscription Agreement and our Privacy Policy, constitute the entire agreement between you and FieldMind AI. They supersede any prior agreements or understandings.
13b. Modifications
We may update these Terms from time to time. We will notify active clients via email at least 14 days before material changes take effect. Your continued use of the Service after the effective date constitutes acceptance.
13c. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
13d. Waiver
Failure to enforce any provision of these Terms shall not be construed as a waiver of that provision or our right to enforce it in the future.
13e. Assignment
You may not assign your rights under these Terms without our prior written consent. FieldMind AI may assign its rights in connection with a merger, acquisition, or sale of substantially all of its assets.
13f. Force Majeure
FieldMind AI shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, natural disasters, government actions, internet infrastructure failures, or third-party platform outages.
